Mumbai: OmniActive Health Technologies has filed a patent infringement lawsuit against Bio-gen Extracts Pvt. Ltd. in the United States District Court for the Eastern District of Texas.
The legal action, filed on June 23, 2025, aims to protect OmniActive’s intellectual property rights under U.S. Patent No. 10,532,035 (‘035 Patent).

At the center of the case is Lute-gen®, a product commercialized by Bio-gen, which OmniActive alleges infringes on its patented method involving the use of marigold-derived lutein and zeaxanthin isomers.
The ‘035 Patent underpins the company’s breakthrough ingredient Lutemax 2020®, a clinically researched and award-winning formulation that supports visual performance and eye health.

Lutemax 2020 and the Importance of Patent Protection in Nutraceutical Innovation
Lutemax 2020 is formulated using specific concentrations and ratios of lutein and zeaxanthin isomers derived from marigold flowers.
The patented method outlined in the ‘035 Patent enables formulation into a wide range of dietary supplements, functional foods, and beverages, giving consumers access to targeted benefits such as improved visual function, cognitive performance, and eye strain reduction.
OmniActive’s legal filing requests:
- A jury trial
- Monetary damages, legal costs, and expenses
- A finding of willful infringement
- A permanent injunction against further use of the patented method by Bio-gen
The lawsuit represents a significant step in defending innovation in the nutraceutical industry, as the company seeks to uphold the integrity of its R&D and ensure a level playing field for science-driven companies.
